Terms And Conditions

In the following terms and conditions the “Photographer” shall mean Sophie Drewicz trading as Sophie Drewicz Photography. The “Client” shall be those person responsible for booking a session. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of these terms shall be effective unless agreed by both parties in writing.

Booking Fees & Cancellation

The Client agrees to pay a non-refundable initial payment totaling 50% (fifty-percent) of the total price of the purchased photography package. The initial payment reserves The Photographer’s time and is not a retainer or a deposit. The Photographer agrees to not advertise availability of this time slot to any other potential clients. If The Client cancels the shoot for any reason within a day before the shoot, the photoshoot can be rescheduled for another day without further cost. A rescheduling will not be possible where cancellation has occurred after this point, however The client is welcome to book a complete new package.

Bookings for photoshoots must be made by person aged 18 and over. All person aged 17 or under must be accompanied and supervised at all times by a parent or legal guardian.

Gift Vouchers are valid for 12 months from the date of purchase and are non-refundable.

Additional charges

The balance of the payment for photography services plus any travel fees agreed at the time of booking and incurred in the journey must be paid in full to The Photographer on the day. – cash or electronic payment.Travel fees are charged at 0.55p per mile outside a radius of 20 miles from RH11. If the portrait session is taking place on location where any entrance fees, parking fees or related expenses are incurred, these will be charged to The Client.

Duty of Client

The Client is responsible to obtain any/ all permissions necessary for The Photographer to photograph at the agreed location. The Photographer is not responsible for obtaining permission at the intended location of the shoot. The Client agrees that any failure to obtain permission resulting in fines to The Photographer, or which prevent The Photographer from photographing the event(s), is not the fault, liability, or responsibility of the Photographer. In addition The Client would be liable to pay the balance of the payment for photography services plus any travel fees and fines incurred.

Failure of The Client to attend the session at the agreed venue and time within 30 minutes will result in the session being cancelled and The Client will lose the initial payment. The Client is welcome to book a complete new package.

Photographer cancellation

The Client will receive a full refund of the initial payment in the event of a cancellation of the photoshoot either through equipment failure or inability by the Photographer to attend (with the exception due to adverse weather conditions) This will form the full extent of the compensation by The Photographer to the Client.

Postponement Due To Weather

If the appointment has to be cancelled by The Photographer due to bad weather conditions a new, agreed appointment will be made at no additional cost.

Indemnification

The Client understands and agrees that the Photographer is not responsible for safety of The Client nor any action of the animal, which may cause damage to property or injury to others.

For equine phootshoots where Clients desire tack-less/ bridle-less photos, Sophie Drewicz Photography provide a thin photoshoot rope halter for that purpose. However, The Client understands that they use this device at their own risk as this is not suitable for restraining or controlling a horse and therefore it is the Clients responsibility to maintain charge of the horse(s) at all times.

Photos

The Client understands and agrees that The Photographer is not required to maintain copies of the photos from this shoot more than sixty (60) days after the photos have been delivered to client.

The Photographer and Client agree that The Photographer is under no obligation to capture any specific moment, or pose, or person(s) during the photoshoot

The Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of Client.

The Photographer will make the edited photos available to The Client for viewing on Sophie Drewicz Photography website in a password-protected, private online gallery, no later than thirty days (30 days) after the date of the photoshoot.

Any photos purchased by the Client are licensed for Client’s personal use only and must not be sold or entered in to any competitions as the Client’s own work nor to use them for any commercial purpose. It is not permitted to screen capture or post any watermarked images from the private gallery not purchased by the Client.

Any Client who shares passwords for an account or private gallery, do so at their own risk.

The Client understands and agrees that physical prints purchased take longer for delivery and will be inspected by Sophie Drewicz Photography for quality before delivering them to the customer.

The Client grants permission to The Photographer (providing they are 18 years or older) to use their image or likeness in any and all forms of media for advertising, trade and personal use.

Copyright and Ownership

The Client understands and accepts that Sophie Drewicz photography holds all rights to the images at all times. It is a criminal offence for The Client or any other Persons to scan copy alter sell and reproduce the photographs in any way.
